06 Consultation on Orders and Regulations relating to the Code of Local Authority Members in England

The Department for Communities and Local Government is currently consulting in respect of the new regulations and orders, which will flow from the Local Government and Public Involvement in Health Act 2007. Many of the regulations and orders relate to new provisions, which will be dealt with by Standards Committee. This report sets out the proposed consultation response, the deadline for which is 15 February, i.e. prior to the meeting of the Standards Committee. It has, therefore, been necessary to request that the Fire Authority agree the response at its meeting on 13 February.

11 The Code Uncovered

As part of its continued support the Standards Board for England has produced a DVD, which uses a fictional planning application dispute to illustrate the key changes to the revised Model Code of Conduct. The DVD examines the rules about declaring interests, disclosing confidential information and bullying. The Board has recommended that standards committees and officers watch this DVD and use it as a tool for discussion. Accordingly, the Committee will be asked to watch the DVD at this point in the meeting and to consider whether or not a screening of the DVD should be provided for all Members of the Fire Authority, in the presence of the Monitoring Officer, in order that any questions raised can be addressed.

09 Members’ Allowances

At its meeting in December 2006 the Fire Authority agreed its 2007/08 Scheme for the Payment of Members’ Allowances. One of the changes introduced relates specifically to allowances payable to Independent Members of its Standards Committee. Currently, the Scheme provides for an additional allowance of £50 for up to 4 hours and £100 for over 4 hours to be paid to the non-elected, Independent Members of the Fire Authority’s Standards Committee, should they be required to determine locally any allegations of breaches of the Code of Conduct (if they incur a financial loss or represent a small organisation, which would otherwise have to bear the cost). The Fire Authority has agreed with effect from 1 April 2007 to delete the words in brackets and insert instead ‘subject to application by individuals’.

10 West Mercia Independent Members’ Forum

The Fire Authority hosted a meeting of the West Mercia Independent Members’ Forum 26 January 2007 at the Shropshire Education and Conference Centre, Royal Shrewsbury Hospital, Shrewsbury. Patricia Hughes, Deputy Chair of the Standards Board for England, gave a talk about recent developments, including the White paper, and also about the workings of the Board itself. The Fire Authority’s Clerk and Monitoring Officer and Corporate Services Manager and Management Support Officer were present to provide support throughout the meeting. A copy of the draft minutes of the meeting is attached marked 10.

12 Consultation on Revised Model Code of Conduct

On 22 January Communities and Local Government published a consultation paper seeking views on a draft new Model Code of Conduct for Local Authority Members, responses to which were required by 9 March 2007. This report summarises the more significant changes proposed and sets out the Fire Authority’s response to the consultation paper.

12 Training in Revised Model Code of Conduct

Telford & Wrekin Council has arranged for training in the revised Model Code of Conduct to take place on Monday, 18 June 2007 at the Civic Offices, Telford. There will be two identical sessions: on in the afternoon and one in the evening, to allow as many Members as possible to attend. All Members of the Fire Authority, including the two Independent Members of the Standards Committee, have been invited. To date, responses have been received from half of the Fire Authority Members.

14 Annual Assembly

The Sixth Annual Assembly of Standards Committees will take place on 15 and 16 October this year at the International Convention Centre, Birmingham. Two places have been booked, one for a Member of the Standards Committee and one for an officer of the Fire Authority. It is proposed that whoever is the Chair of the Standards Committee at that time should attend. Members are asked to agree this proposal.

To receive the minutes of the meeting of the West Midlands Independent Members’ Forum, held on 3 February 2006 at Brockington, Hereford.

Next Meeting
Members will recall that in January of this year the Standards Committee offered to host a meeting of the Forum in Shropshire. It has now been confirmed that the meeting will take place at 2.00 pm for 2.30 pm on Friday, 26 January 2007. The venue will be the Shropshire Education and Conference Centre, Royal Shrewsbury Hospital, Shrewsbury. The two Independent Members of the Fire Authority’s Standards Committee together with the Chief Fire Officer, the Clerk and Monitoring Officer, the Standards Committee Solicitor and Committee Clerks will attend.

09 Annual Assembly

The Fifth Annual Assembly of Standards Committees will take place on 16 and 17 October this year at the International Conference Centre, Birmingham. Two places have been booked, one for a Member of the Standards Committee and one for an officer of the Fire Authority. It is proposed that whoever is the Chair of the Standards Committee at that time should attend. Members are asked to agree this proposal.

05 Procedure for Local Investigation of Referred Complaints

At the last meeting of the Committee Members approved a Procedure for Local Investigation of Referred Complaints but agreed that the reference to indemnities at paragraph 5.4 of the Procedure be deleted, pending a decision from the Fire Authority regarding indemnities (see section 7 of the minutes referred to at item 3 above). The Fire Authority agreed, at its meeting on 14 December 2005, that it take out Code of Conduct insurance for all of its Members and Independent Members of its Standards Committee. The wording of paragraph 5.4 has, therefore, been amended to reflect this decision and a copy of the amended Procedure is attached, marked 5. Members are asked to agree the amendments shown struck through and in italics.

This report informs the Committee of the contents of the report “Standards of Conduct in English Local Government: The Future”, recently published by the Office of the Deputy Prime Minister. That report sets out changes to be made both to the Code of Conduct for Members and the procedures for dealing with complaints that Members have breached the Code.
